Unilateral changes to opening hours are prohibited from 1 January 2022

On July 14, 2021, a legislative amendment to the shopping hours law was passed by the Senate that gives franchisees (and retailers) more control over their opening hours. In short, this law means that franchisors (and landlords) are not allowed to change the opening hours of franchisees (and tenants) without explicit consent. On October 20, 2021, it was announced that the law will enter into force on January 1, 2022.

Amsterdam Court of Appeal restricts franchisor’s appeal to non-competition – dated July 6, 2020 – mr. T. Meijer

On 30 June 20202, the Amsterdam Court of Appeal ruled that a franchisor is not entitled to an (unlimited) appeal to a contractual non-competition clause.
